INTRODUCTION

 

Nehru Yuva Kendra Sangathan (NYKS) is an autonomous organization of the Ministry of  Youth Affairs and Sports with its offices in 623 districts of India .    NYKS is the largest grass-root level apolitical organization in the world, catering to the needs of more than 34.92 lakh non-student rural youth   enrolled through 1.79 lakh village based youth organizations called Youth Clubs in the areas covering education and training, awareness generation, skill development and self-employment, enterprise creation, thrift and cooperation, besides development of the body through  sports and adventure and  mind through sustained exposure to new ideas and development strategies. For organization of these activities, supervision, monitoring and evaluation, there are  29 State Offices across the country. In addition, programmes with active involvement and participation of rural youth in the areas such as Health, Family Welfare, HIV-AIDS, Drug Abuse, Poverty Alleviation, Child Labour, Environment, Enrichment, Literacy, Women Empowerment, Eradication of Social Evils and other issues of Local, National and International importance are being undertaken in the villages with emphasis on value, vision and voluntary action.

 

The basic idea behind the above strategy is to bring forth the rural youth into the mainstream of national development as active participants, responsible and productive citizens of  modern and technological India, since the young people are not only a major human resource for development but also key agents for social change, economic development and technological innovation.  Their imaginations, ideals, considerable energy and vision are essential in the continuing development of the society in which they live.  The problems that young people face as well as their vision and aspirations are essential component of the challenge and prospects of today’s society and future generation.  Consequently while paying focused attention on these aspects,  NYKS has subsequently evolved emerged not merely as an organization, but as a rural youth movement in the country.

 

 

 


HOW TO APPLY UNDER RTI ACT

The following may be noted while submitting request for seeking information under RTI Act:-

·      Arrangements have been made at the Facilitation Counter of NYKS HQRS  for receiving applications/request seeking information under RTI Act, 2005.

·       Application/request can also be sent by post alongwith the requisite fee directly to the  CPIO in NYKS HQRS,  CPIO in NYKS State Offices and kendras ;

·       The requisite fee alongwith the application/request could be paid by way of cash against proper receipt  or by demand draft or banker's cheque or I.P.O drawn in favour of “NYKS” for information as from PIO at hqrs &  State Offices and “ Youth Coordinator, Nehru Yuva Kendra _________ (name of the district) for information required from the Kendra ;

MEMORANDUM OF ASSOCIATION

 

1.     The name of the Society shall be the Nehru Yuva Kendra Sangathan (hereinafter referred to as the ‘Sangathan’).

 

2.    The Registered office of the Sangathan shall be situated in the Union Territory of Delhi/New Delhi and is at present at the Shastri Bhawan, New Delhi .

3.    The objects for which the Sangathan is established are :-

 

i)            To take over, manage, administer and run the existing Nehru Yuva Kendra;

ii)           To establish, run, manage and administer new Nehru Yuva Kendras anywhere in India and evaluate their working;

iii)         To promote and develop the concept of national integration, solidarity and secularism among the youth;

iv)         To involve the youth in programmes that would facilitate the organization of youth leadership training programme, community singing, cultural activities, work camps, sports activities, self-help programmes, physical and Adult Education, character building and Co-operative movement etc.

v)          To function as a coordinating agency to link the youth with various departments/agencies of the Government administering programmes like Integrated Rural Development Programme (IRDP), Training of Rural Youth for Self Employment (TRYSEM), Self-Employment, Health and Family Welfare Programmes, Adult Education etc.;

vi)         To create an awareness among the rural youth and providing them necessary guidance for taking advantage of various rural development programmes;

vii)          To organize special training programmes for the functionaries in order to familiarize them with the programmes/schemes of various departments/agencies being implemented in rural areas;

viii)        To establish, run, manage and administer Regional offices of Sangathan anywhere in India ;

ix)        To create administrative, technical and non-technical and other posts and to make appointments, promotions and transfer thereto;

x)          To collaborate with State Governments, Union Territory Administrations and other Organizations in and outside India for furtherance of its objectives;

xi)        To advise the Government of India on all matters within its purview either suo-motto or on a reference from the Government;

xii)          To organize, sponsor, and finance seminars, conferences etc. in the field of youth and allied matters;

xiii)        To undertake, sponsor and encourage publication of journals and literature relating to youth; stipends in the implementation of these objects;

xiv)       To institute, offer and grant prizes, awards and stipends in the implementation of these objects;

xv)       To constitute Boards, Committees or other bodies as may be deemed fit and to prescribe their powers, functions, tenure etc;

xvi)       To accept and collect donations, grants and gifts and to undertake management of any endowment or trust and to make donations, grants and gifts for the purpose of these objects;

xvii)      To borrow and raise money with or without security of moveable and immoveable properties belonging to the Sangathan provided that the prior approval of the Government of India is obtained in that behalf;

xviii)    To acquire, purchase or otherwise own, take on lease or hire, moveable and immoveable properties and to sell, mortgage, transfer or otherwise dispose of any such moveable or immoveable properties, but the prior approval of the Government of India in respect of such immoveable properties shall be obtained;

xix)       To make Rules and Regulations for the conduct of the affairs of the Sangathan and to add, amend, vary or repeal them from time to time;

xx)       To maintain a ‘Fund’ which shall be vested in the Sangathan;

xxi)        Generally to take all such measures as may be found necessary from time to time to achieve its objectives; and

xxii)      To do all such acts and things as the Sangathan may consider necessary, conducive or incidental to the attainment or enlargement of the aforesaid objects or any one of them.

 

4.   All the incomes, earnings, moveable or immoveable properties of the Sangathan Society shall be solely utilized and applied towards the promotion of its aims and objects only as set forth in the Memorandum of Association and no portion thereof shall be paid or transferred directly or indirectly by way of dividends, bonus profits or in any manner whatsoever, to the present or past members of the Sangathan Society or to any person claiming through any one or more of the present or the past members.  No member of the Sangathan Society shall have any personal claim on any moveable or immoveable properties of the Sangathan Society to make any profits, whatsoever, by virtue of this membership.

RULES OF THE NEHRU YUVA KENDRA SANGATHAN

 

 

Rule No.

PARTICULARS

Short Title

1

(a)       These Rules may be called the ‘Rules of the Nehru Yuva Kendra Sangathan 1986.’

(b)       These Rules shall come into force from the date on which the Society, namely the Nehru Yuva Kendra Sangathan is registered under the Societies’ Registration Act, 1860.

Definitions

In these Rules, unless the context otherwise requires :-

 

a)      “The society or the Sangathan” means the ‘Nehru Yuva Kendra Sangathan’;

b)      “Sangathan Society” means the body constituted under Rule 4 of these Rules;

c)      “Board of Governors” means the body constituted under Rule 30 of these Rules;

d)      ‘Government’ means the Government of India;

e)      “Chairperson” means the Chairperson of the ‘Sangathan’;

f)        “Vice Chairperson” means the Vice Chairperson of the ‘Sangathan’;

g)      ‘Director General’ means the person appointed by the Government to be the Director General of the ‘Sangathan’;

h)      “The Member Secretary” means the person appointed by the Government of India to be the Director General of the ‘Sangathan’;

i)        ‘Year’ means, unless otherwise specified by the Sangathan, the financial year of the government.

 

 

I    THE SANGATHAN SOCIETY

The Office of the Sangathan shall be situated at Delhi/New Delhi at such place (s) in Delhi/New Delhi, as may, from time to time be decided by the Board of Governors.

a) The Society registered under the name of Nehru Yuva Kendra Sangathan shall have the following members :-

Three of the members of the Society may be nominated by Government to be its Vice Chairpersons. All the VCs would enjoy the same benefits, perks and privileges.

Special Invitees

The Chairperson of the Sangathan Society may invite up to three persons to attend the meetings of the Sangathan as special invitees. Such an invitee shall not be entitled to vote at the meetings.

Register of Members

The Sangathan shall maintain a roll of members indicating their full names, addresses and occupations and every member shall sign the same. If a member of the Sangathan changes his address he shall notify his new address to the Member-Secretary of the Sangathan, who shall have the entry in the roll of members changed accordingly, where, however, a member does not notify any change of address to the Member Secretary of the Sangathan, his address given in the roll of members, shall be deemed to be his correct address.

Determination of ex-officio Membership

(a)    where a person becomes a member of the Sangathan by virtue of the Office or appointment which he holds, his membership of the Sangathan shall terminate when he ceases to hold that office or appointment.

(b)   Members of the Sangathan nominated from amongst the Members of both Houses of Parliament shall cease to be members of the Sangathan on the dissolution of the House or on the expiry of their term or on ceasing to be members of the House, whichever is earlier.

Determination of Membership of others

(a)    Membership of members other than ex-officio members shall be determined on the happening of any of the following events:--

  1. On the expiry of the term of membership;
  2. Death, resignation, insolvency, lunancy or conviction for a criminal offence involving moral turpitude

(b)   The Government may at any time terminate the membership of any one or more of the members. Upon such termination, the vacancies shall be filled in accordance with the relevant provisions of these Rules.

Term of Membership

(a)    Subject to other provisions, a nominated member of the Sangathan shall hold office for a period of three years from the date of his nomination. A member can be nominated for a maximum of two terms.

(b)   If a casual vacancy occurs during the three year period, such vacancy shall be filled in the same manner as the original vacancy and the member so nominated shall hold office for the unexpired portion of the three year term

Resignation from membership and date of its effect

When a member desires to resign his membership of the Sangathan, he shall forward his letter of resignation to the Director General. The resignation shall take effect only from the date of its acceptance by the Chairperson.

Validation of acts

The Sangathan shall function notwithstanding any vacancy in its body and no act, direction of proceeding of the Sangathan shall be invalid merely by reason of such vacancy or any defect in the appointment of any of its members.

 

 

 

II.                 Authorities of the Sangathan

The Director General shall be the Chief Executive Officer of the Sangathan. He shall be appointed by the Government.

Appointment of officers and members of staff of the Sangathan

The Sangathan or the authorities competent under these Rules and bye- laws framed under these Rules to make such appointments may appoint the officers and members of the staff of the Sangathan as may be required to assist the Director General and / or Officers sub-ordinate to him for carrying out the objects set forth in the Memorandum of Association of the Sangathan.

Powers of the Sangathan

The Sangathan shall have, subject to such restrictions as the Government may impose and subject to such directions/guidelines as the Government of India may issue from time to time in this behalf, full authority to perform all acts and issue such directions to Officers and bodies sub- ordinates to it as may be considered necessary, incidental or conducive to the attainment of the objects enunciated in the Memorandum of Association of the Sangathan..

Review of progress and performance of the constituents units

The Sangathan shall review in its meeting (s) held at least once a year the progress and performance of the Sangathan and give such policy directions, as it may deem fit

Notice of Meetings etc.

A notice or any other information may be served upon a Member of the Sangathan either personally or by sending it through post in an envelop addressed to such member at his address as noted in the Roll of Members.

 

 

 

III   CHAIRPERSON

 

Powers

(a)                                      The Chairperson shall exercise such powers for the conduct of the business of the Sangathan as provided in these Rules or as may be vested in him/her by the Sangathan from time to time.

(b)                                      Without prejudice to the generality of sub rule

(a)    above, the Chairperson shall have powers to :-

(i)      call for any information, document or data pertaining to the Sangathan;

(ii)            issue such directions or instructions to any of the authorities of the Sangathan as he/she deems appropriate in the interest of the Sangathan;

(iii)            review the work and progress of the Sangathan

(iv)            appoint Committee or Commissions to enquire into and report on the affairs of the Sangathan and pass such orders thereon as he/she considers proper; and and

(v)            direct convening the meeting of the Sangathan for any purpose at any time on proper notice..

Delegation of powers

The Chairperson may, by writing delegate such of his/her powers as he/she may consider necessary to the Vice Chairperson and the Director General

 

 

 

IV  DIRECTOR GENERAL

 

Powers and Functions

(a)      Subject to any order that may be passed by the Government and other authorities of the Sangathan, the Director General as the Principal Executive Officer shall be responsible for :-

(i)            the proper administration of the affairs, and subject to Rule 51, of the funds of the Sangathan;

(ii)          prescribing the duties of all employees of the Sangathan;

(iii)         exercising supervision and disciplinary control over the work and conduct of all employees of the Sangathan;

(iv)        co-coordinating and exercising general supervision over all the activities of the Sangathan; and

(v)          executing all contracts, deeds and other instruments on behalf of the Sangathan, if so authorized by the Board of Governors.

(b)      (b) In the absence of the Director General on long leave, deputation in India or abroad or at the time of laying down office, arrangements to look after his duties may be made by the chairperson with the approval of the Government.

(c)      The Director General shall exercise all administrative and financial powers as have been conferred on him under these Rules and such of the powers as may be delegated to him from time to time.

(d)      For the purpose of Section 6 of the Societies’ Registration Act (21 of 1860), the Director General shall be considered the Principal Executive Officer of the Sangathan and may sue or be used in the name of the Director General of the Sangathan. The Director General may authorize any other officer of the Sangathan in writing to sign and verify pleadings on his behalf  The Director General may authorize any other officer of the Sangathan in writing to sign and verify pleadings on his behalf.

(e)      The Director General may, in writing, with the approval of the chairperson delegate such of his powers as he may consider necessary to the officers below him in the Sangathan.

(f)        The Director General shall function under the directions of the Sangathan and the Chairperson.

(g)      (g) The Director General shall be responsible for issuing notices of the meetings of the Sangathan Society and its Board of Governors and keeping or causing to be kept minutes of the proceedings of the Sangathan Society and the Board of Governors

(h)      (h) The Director General shall keep or cause to be kept all records of the Sangathan at its office or any other place if so determined by the Board of Governors.

 

 

 

V   SANGATHAN SOCIETY

 

Members

There shall be a Sangathan Society of the Sangathan and it shall be composed of all members of the Sangathan.

 

 

 

VI    MEETINGS OF THE SANGATHAN SOCIETY

 

Annual General Meeting

22

The Annual Sangathan Society Meeting of the Sangathan shall be held on such date, time and place as may be determined by the Chairperson to transact the following business :-

 

(i)               Consideration of the annual report of the Sangathan;

(ii)                Consideration of the annual accounts of the Sangathan together with the audited report thereon;

(iii)               Other business in the agenda.

Special General Meeting

(a)    The Chairperson may convene a Special Meeting of the Sangathan Society whenever he/she thinks fit.

(b)   At all Special Meetings, no subject other than stated in the notice or requisition as the case may be, shall be discussed except when specially authorized by the Chairperson.

(c)    Any requisition so made by the Members of the Sangathan Society shall express the object of the meeting proposed to be called and shall be left at the office of the Director General.

(d)   The chairperson shall convene a special Meeting of the Sangathan Society on the written requisition of not less than three Members of the Sangathan.

Calling of the Meetings

All Meetings of the Sangathan Society shall be called by notice in writing by and under the hand of the Director General.

Every notice calling a meeting of the Sangathan Society shall state the date, time and place of the meeting and shall be served upon every Member of the Sangathan not less than 10 clear days before the day appointed for the meeting.

Validation of meeting due to late or non-receipt of notice

Any inadvertent omission to give notice to, or non-receipt or late receipt of notice by, any Member shall not invalidate the proceedings of the meeting.

Chairperson of the Meetings and his/her election

The Chairperson shall preside over all meetings of the Sangathan Society. In his/her absence, the Vice-Chairperson shall preside over the meetings of the Sangathan. In the absence of both the Chairperson and Vice Chairperson the Members present shall choose one from among themselves to be the Chairman of the meeting.

Quorum

Four Members of the Sangathan Society present in person shall form a quorum at any meeting of the Sangathan

Determination of disputed questions by vote

29

(a)    All disputed questions at any meeting of the Sangathan shall be determined by vote of the Members excluding co-opted ones or special invitees present and voting.

(b)   Each member of the Sangathan shall have one vote.

(c)    In case of the equality of votes, the Chairperson shall have a casting vote.

The Chairperson of the Board of Governors may invite from time to time additional persons up to three members as considered necessary to attend the meetings of the Board of Governors as special invitees. Such an invitee shall not be entitled to vote at the meetings.

The Board of Governors shall generally pursue and carry out the objects of the Sangathan set forth in its Memorandum of Association and in doing so, shall follow and implement the directions/guidelines laid down by the government or the Sangathan Society.

Powers

33

(a)    the Board of Governors shall exercise all administrative and financial powers of the Sangathan including those vested in orconferred or to be conferred on it by or under any statutes subject nevertheless in respect of expenditure to such limitations as the Government may, from time to time impose.

(b)   In particular and without prejudice to the generality of the foregoing provisions, the Board of Governors shall have the powers, subject to the provisions of these Rules and bye-laws framed there under to :-

(j)        finalise the annual and supplementary budget estimates with such modifications as may be deemed necessary;

(ii)                Approve the annual account of the Sangathan and forward for statutory audit.

(iii)               Establish, maintain, amalgamate and/or close Kendras, Institutions, Units, Centres, Branches, Regional Offices, Residential areas, buildings etc.;

(iv)              Enter into arrangements with the Government and through the Government with foreign and international agencies and organizations, the State Governments and other bodies or organizations for the furtherance of the objects of the Sangathan;

(v)                Appoint and dissolve committees and sub-committees consisting of persons who may not be members of the Sangathan or employees of the Sangathan, for the purpose of the Sangathan;

(vi)              Accept and collect donations, grants, gifts and to undertake management of any endowment or trust fund and to make donations, grants and gifts for the purpose of the Sangathan

(vii)             Determine the number, the order and grades of pay of posts, to create, suspend or abolish the posts and fix emoluments and terms of service of the employees of the Sangathan subject to such terms and conditions as Government may, if it so chooses, prescribe from time to time

(viii)           (viii) Appoint all staff as may be needed for the Sangathan on such terms and on conditions as may be deemed fit and proper subject further to such terms and conditions as theGovernment may, if it so desires, prescribe from time to time ;

(ix)              With the previous approval of the Government, acquire by gift, purchase, exchange, lease on hire or otherwise, whatsoever any lands, buildings, easements, or any immoveable property or any estate or interest for furtherance of all or any of the objects of the Sangathan;

(x)                With the previous approval of the Government, build, construct and maintain houses or other buildings and alter, extend, improve, repair, enlarge, or modify the same including any existing buildings and to provide and equip the same with light, water drainage, furniture fittings, instruments, apparatus and appliances and all other necessaries for the use to which each building is to be put;

(xi)              With the previous approval of the government construct or otherwise acquire, lay out repairs, extend, alter, enlarge, improve and use any land and/or any other immoveable property belonging to or held by the Sangathan;

(xii)             Accept and receive in any manner whatsoever any cash or immoveable or moveable property either unconditionally or subject to any special trusts created by any particular donor in furtherance of any one or more of the objects of the Sangathan;

(xiii)           Sell, manage, transfer, exchange, mortgage, demise, dispose of or otherwise deal with any properties of the Sangathan, moveable or immoveable, provided that prior approval of the Government shall be obtained in respect of immoveable properties on such terms and conditions as may be approved by the Government;

(xiv)           Raise and borrow money on bonus, mortgage, promissory notes or other obligations or securities founded or based upon all or any of the properties and assets of the Sangathan or without any securities and upon such terms and conditions as may be approved by the Government;

(xv)            To invest and deal with any funds of the Sangathan in or upon such securities as the Sangathan may deem fit and from time to time transpose any investments;

(xvi)           Make such grants as the Sangathan may think fit for the benefit of any employee of the Sangathan;

(xvii)         Make draw, accept, endorse and negotiate respectively promissory notes, bills, cheques or other negotiable instruments;

(xviii)        Subject to the approval of the Sangathan and prior approval of the Government make and from time to time amend and repeal such rules and bye-laws as may be necessary for administering and regulating the affairs of the Sangathan; and

(xix)           Delegate such administrative, financial and other powers to the Director General and any other officer of the Sangathan it may consider necessary and proper.

Frequency of meetings

The Board of Governors shall meet as often as necessary and ordinarily at least once in each quarter of the year.

Date, time and place of meetings

The meetings of the Board of Governors shall be held on such date, time and place as may be determined by the Chairperson.

Notice for meetings and its service

(a)    All meetings of the Board of Governors shall be called by notice in writing by and under the hand of the Member-Secretary.

(b)   Every notice calling a meeting of the Board of Governors shall state the date, time and place of the meeting and shall be served upon every member of the Board ordinarily not less than ten clear days before the day appointed for the meeting.

Validation of proceedings of meetings

Any inadvertent omission to give notice to or non-receipt or late receipt of notice by, any Member shall not invalidate the proceedings of the meeting..

Chairperson of the Meetings

Meetings of the Board of Governors shall be presided over by its Chairperson. In his/her absence, the Vice Chairperson shall preside over the meeting. In the absence of both, the Members of the board present at the meeting may elect a Member amongst themselves to be Chairperson of that meeting.

Quorum

Four Members of the Board of Governors present in person shall constitute the quorum for meeting of the Board.

Determination of matters by majority vote

Each member of the Board of Governors shall have one vote. The matter to be determined by the Board shall be decided by a majority of votes. In the event of there being the equality of votes or any question, the Chairperson shall have a casting vote.

Conduct of business by circulation of resolution

Subject to the provision to Rule 40 above, any business, which may be necessary for the Board of Governors to perform, may be performed by a resolution in writing, circulate among all its members, and any such resolution so circulated and approved by a majority of members shall be as effectual and binding as if such resolution had been passed at a meeting of the Board.

Approval of Proceedings

The proceedings of all meetings of the Board of Governors and the resolution passed shall be submitted by the Member-Secretary to the Chairperson of the Board for approval.

Action on proceedings

Action on the proceedings of the meetings of the Board of Governors shall be taken expeditiously. A copy of the proceedings shall be submitted to the Chairperson for information and directions, if any 

Funds of the Sangathan

The funds of the Sangathan shall consist of the following:-

(i)                  Grants received by the Sangathan from the Government, State Governments, Union Territories Administrations etc.

(ii)                Donations, gifts and the amounts otherwise received by the Sangathan.

(iii)               Income and receipts from other sources.

(iv)              Income from investments.

(v)                Income from any other source.

Property and Income of the Sangathan

All properties of the Sangathan-moveable or immoveable shall vest in the Sangathan and shall be administered by the Board of Governors within the parameters set by the Sangathan in its general meeting or otherwise as directed by the Government.

The Sangathan may purchase, hire lease, exchange or otherwise acquire property moveable or immoveable, tangible or intangible (including copyrights patents and intellectual properties) which may be necessary or convenient for the Sangathan and construct, alter and/or maintain such buildings and works as may be necessary for carrying out the objects of the Sangathan.

The Sangathan may sell, hire, lease, exchange or otherwise transfer or dispose of all or/any property, moveable or immoveable property of the Sangathan provided that for the transfer of immoveable property, prior approval of the Government of India is obtained.

The income and property of the Sangathan, however, derived shall be applied towards the promotion of the objects thereof as set forth in its Memorandum of Association, subject nevertheless, in respect of the expenditure of grants made by the Government, on such conditions or limitations as the Government, may, from time to time impose. No portion of the income and property of the Sangathan shall be paid or transferred directly or indirectly by way of dividends, bonus or otherwise howsoever, by way of profit, to the person, who at any time are or have been Members of the Sangathan or to any of them or to any person claiming through them or any of them provided that nothing therein contained shall prevent the payment in good faith of honorarium to any Member thereof or other person in return for any service rendered to the Sangathan.

Bankers of the Sangathan

(i)                  The Bankers of the Sangathan shall be the State Bank of India and its subsidiaries and/or Nationalized Banks.

(ii)                Unless otherwise authorized by the Board of Governors no new account shall be opened

(iii)               No amount shall be withdrawn from the Sangathan’s account in a Bank except by a cheque signed and countersigned by such officers as may be duly empowered in this behalf by the Board of Governors.

Auditors

The accounts of the Sangathan shall be audited by such person or persons as may be nominated for the purpose from time to time by the Government in consultation with the Comptroller and Auditor General of India .

Advice in financial matters

There shall be at the Headquarters of the Sangathan a whole-time financial Adviser, who shall be responsible for preparation of the budget estimates, maintenance of accounts, internal audit, treasury and other functions as may be entrusted to him by the Board of Governors. The Financial Adviser shall be responsible to the Board of Governors for the above functions. In all matters having financial implications the Financial Adviser shall be consulted and in case of disagreement, his views shall be placed before the Chairperson, or the Board of governors, if so directed by the Chairperson for final orders.

Annual Report

“An Annual Report of the proceedings of the Sangathan and all work undertaken during the year shall be prepared by the Board of Governors for the information of the members of the Sangathan Society and the annual accounts of the Sangathan alongwith the audit report thereon shall be placed before the Sangathan Society at its Annual General Meeting for consideration and adoption. Thereafter, the annual report and annual accounts alongwith the audit report shall be submitted to the Government”.

Seal of the Sangathan

The Board of Governors of the Sangathan shall have a seal which shall be used only with its prior approval in cases where under any law it is necessary for the Sangathan to affix it on a document, or on an instrument or unless the Board of Governors otherwise so decides, such a document/instrument shall be signed by a Member of the Board of Governors and the Member Secretary or/such other officer or person authorized by the Board.

 

 

 

VIII     AMENDMENTS

 

Alteration or extension of the purpose of the Sangathan

Subject to the approval of the Government previously obtained, the Sangathan may alter or extend the purposes for which it is established or be amalgamated either wholly or partially with any other Organization by following the undermentioned procedure:-

 

(a)    The Board of Governors shall convene a Special General Meeting of the Members of the Sangathan, according to these Rules for the consideration of the said proposition;

(b)   The The Board of Governors shall submit the proposition for such alteration, extension or amalgamation as aforesaid to the Members of the Sangathan in a written or printed report;

(c)    Such report shall be delivered or sent by post to every Member of the Sangathan fifteen clear days previous to the said Special General Meeting;

(d)   Such proposition shall be deemed to have been agreed to if not less than three-fifth of the Members of the Sangathan cast their votes in its favour at the said Special General Meeting;

(e)    Such proposition shall be confirmed by the votes of three-fifths of Members of the Sangathan present at the subsequent Special General Meeting convened by the Board of Governors at an interval of one month after the former meeting

Alteration amendment of the Rules

The Rules of the Sangathan may, with the sanction of the Government, be altered at any time by a resolution passed by a majority of the Members of the Sangathan convened for the purpose.

Change of name of the Sangathan

The Sangathan, may change its name as per section 12 and 12-A of the Societies Registration Act, 1860.

Annual List of Board of Governors

57

Once in every year, a list of the office bearers and members of the Board of Governors shall be filed with the Registrar of Societies, Delhi as required under Section 4 of the Societies Registration Act, 1860 as applicable to the Union Territory of Delhi.

Dissolution and adjustment of affairs

If the Sangathan need to be dissolved, it shall be dissolved as per provisions laid down under section 13 and 14 of the Societies’ Registration Act, 1860, as applicable to the Union Territory of Delhi.

If on the winding up or dissolution of the Sangathan, there shall remain, after satisfaction of all its debts and liabilities, any property whatsoever, the same shall not be paid to, or distributed among the members of the Sangathan or any of them but shall be dealt within such manner as the Government may determine.

Application of Societies Registration Act

All the provisions under all the Sections of the Societies’ Registration Act 1860, as applicable to the Union Territory of Delhi, shall apply to this Sangathan.

To deal with Civil petitions filed by some employees in the Hon’ble Courts, to deal with the complaints of the employees and initiate disciplinary proceedings against them.  To deal with vigilance matters of the entire Sangathan.
Administrative officer in the Zonal offices is second in command to the Zonal Director and is responsible for Administrative/ Personnel/Programme matters.   He is responsible to maintain personnel files and ACRs of employees of the entire State.
At the Headquarter level, different Wings,  are managing and looking after the work relating to General Administration, Personnel, Programme, Coordination and RET/EMI.  Section Officer is responsible to supervise the work of the section at hqrs including movement of files and record his comments.

Hindi Translator is responsible to implement the official language policy of the Government of India, assist the various committees in implementation of the policies and do the work of translation in Hindi/English   and regional language for implementing the tri-lingual.

They will be responsible for adjustment of TA/Medical, maintenance of PF etc. under the direct supervision of AAO.
The main job of auditor is to analyse the audit reports, recommend for special audit of the Kendras whose report is in negative. Maintain the audit record, payment of audit fees, appointment of Internal Auditors for the conduct of internal audit of the State Offices, Regional Offices and Kendras.
The main job of the Junior Accountant is to assist the AAO in maintaining the accounts, budget control, passing of TA/medical bills, maintenance of  Provident Fund accounts, adjustment of utilization certificates, processing and calculating the income tax, preparation of salary bill and pre-audit of FVCs etc.

 The Stenographers shall be responsible for dictation, maintaining tour programmes/diaries and also for overall supervising  of Directors’ secretariat.

The duties and responsibilities of Assistant is to maintain and start the files/records at the Section level.
Librarian will be responsible for the Library books , magazines, periodicals, news papers etc of the NYKS

Due to increase of work load owing to setting up of 19 State Offices and 46 Regional Offices, four directors have been posted in the Hqrs to manage and look after the activities of the various wings. For these Director proposed 5 post of Steno Grade-II for the smooth conduct of the work.
To feed and maintain the data relating to programmes, accounts, employees, inspection, special programmes, data of RET, EMI etc.
AA is responsible to deal with the day to day official correspondence being dealt in different sections at the Hqrs. Collect data and informations to prepare notes and statements at the initial stage for submission.
LDC is  responsible to deal with day to day official work as assigned to them from the concerned section heads such as Typing etc.  They are suppose to dispose off the DAK and maintain charts and registers etc; of the wing and acquaint themselves with latest rules and regulations.

Non-official members should be from the Social Workers, Educationists and Ex-Servicemen belonging to the district. They will be nominated to the DACYP. The Youth Club leaders will elect three representatives from amongst themselves to be represented in the DACYP. Similarly, the NSVs will also elect one representative from amongst themselves. In case of a tie in the voting the Youth Coordinator will have the right to choose.

 

The term of non-official members and youth leaders will be three years and of National Service Volunteers one Year (or the date on which the volunteership is terminated, whichever is earlier).

 

Functions

·  To help the NYK in the implementation of its plans and programmes

·  To help and guide the NYK in promoting an effective youth movement in the district

·  To help the NYK in the coordination of its activities with other government and non-government departments and agencies

·  To review and evaluate the work of the NYK and suggest measures for its further improvement.

Meeting

The DACYP must meet quarterly. The meetings may be called in April, July, November and January.

Regular Programme Section : The main duties assigned to this section are

1. Framing of guidelines for Annual Action Plan

2. Monthly Progress Report

3. Quarterly Progress Report

4. Half Yearly Progress Report

5. Annual Progress Report

6. Monthly Note for the Cabinet

7. Reply to Parliament Questions

8. Reply to Parliamentary Standing Committee Questions

 

 

Special Programme Section   : The main duties assigned to this section are

 

1. Preparation of Project proposals for grant-in-aid from different ministries/agencies

2. Getting the special programmes/projects implemented

3. Monitoring of the programmes through progress reports

4. Liaisoning with the partner agencies and stakeholders

5.    Preparation of Guidelines, MOUs

6.    Organise training programmes for the project personnel and stakeholders

7.    HR practices for the Projects

 

 

SGSY Section : The main task of this section is to keep the progress of SGSY scheme being run in 14 districts

 

 

3.    ACCOUNTS SECTION   : The main duties assigned to this section are

·   Preparation of budget

·   Release of funds as per budget provisions/Annual Action Plan

·   Compilation of accounts

·   Audit of accounts (Internal & Statutory)

·   Grant-in-Aid from MYAS and various other agencies

·   Release of Pension, Gratuity and Leave Encashment

 

The following work relating to hqrs are also assigned to this section :

·   Processing of Bills received from Gen Admn Section

·   Processing of Personal claims of staff at hqrs

·   Release of Salary

 

 

4.    GENERAL ADMINISTRATION SECTION : This section has following cells

General administration section

·  Procurement and issue of consumable and non consumable items and processing of bills

·  Reimbursement of personal claims (newspaper bills & telephone bills)

·  Booking of air/rail tickets and processing of payments

·  TA/Medical claims matters of staff at hqrs and State Directors

·  Processing of Tentative Tour Programme of State Directors

·  Liveries to Group ‘D’ and Staff Car Drivers

·  Employment and Deployment of daily wagers at Hqrs and processing of their wages

·  All work relating to hospitality, entertainment during programmes organised in or by Hqrs

·  Photocopying work

·  Maintenance of Asset Registers and Stores

·  Allotment of vehicles at Hqrs

·  Repair & Maintenance of vehicles

·  Processing of cases relating to release of funds for construction of kendra complex on the land allotted by the Dist Admn

·  Matters relating to special sanctions received from field offices

·  Rationalisation of kendras

·  Misc matters relating to field offices

 

 

5.     VIGILANCE SECTION : This section processes cases relating to complaints against employees and also their grievances.

 

 

6.  RET SECTION  : The Monitoring & Evaluation of the programmes and Training to Staff is the main task      assigned to this section.

 

 

7.    MEDIA SECTION :

 

·  Documentation and Process documentation of all major events

·  Publication of monthly newsletter “Nehru Yuva Sandesh”

·  Publication of various information booklets, handbooks, guides and brochures on programmes and activities of NYKS

·  Publication of Annual Reports, Annual Action Plan

·  Press and Media management and release of Press releases and advertisements

·  Compilation and collation of material relevant for Youth for promoting principles of secularism development, harmony and peaceful coexistence.
